Selling/Giving Old Versions?

I just want to make sure I wouldn't be doing anything illegal, if I gave an older version of my software to my brother, when I upgrade, or if I sell it to a friend. This issue is not unique to this company, or this product, I just want to know in general. I think it may be O.K., but I just feel weird, somehow ;-)

I think each company licenses their products any way they see fit, but in general, I don't think you can do that. In most instances that I am aware of, when you get a product at a reduced upgrade price, the stipulation is that you cannot sell, give away, etc. the older version. But, I could be wrong.

CraigWY, I don't think that companies expect you to sell the old version, once you buy the upgrade :-) Specifically speaking of Precision Mapping, I believe that the licensing agreement you agree to, during installation prohibits the transfer of the software to someone else, without permission from them.

Indeed, it does and you are right. Most companies do not allow selling/giving the old version to someone else.

This counts for upgrades only. Because the base software must be used with the upgrade then the license is used up with the upgrade!

If I bought an old FULL version and gave it to someone else, it is only illegal if someone else is using it elsewhere. If I have a new version and have completely removed the old version, then it's not a problem legally. The key to licenses for a single-user product is that it can only be used on a single system.

This is a stretch, but sometimes what's legal is that a copy of the software could be installed on another system at the same time but they are not supposed to be used at the same time. For example, I have a very fast and capable desktop that I do most of my planning, but then I use the laptop when actually traveling and using the software and I can't use it on the desktop at the same time. I got permission from UnderTow to do this and not all companies allow this. The rules are typically written in the Product license and UnderTow licenses do not allow more than a single-use at a time, at least for RTN, last I checked. (Who reads it all?)

I think companies should allow the user to install the program on more than one system. Nowadays, most of us have 2, sometimes 3 different computers (home, office, RV). Why restrict it?

That's why sometimes a company has what's called a multiuser license or a site license where either more than one copy (up to some limit) can be legally used by more than one user, or the license allows for a whole site of users at the same site to use a bit of software.

Read the license to know its limitations. It's how capitalism works! The inventor(s) deserves credit (cash is even better) for the sweat and effort they incurred while providing something someone wants and likes to use and every copy or license deserves its revenue. If you don't like the price, then don't buy it. It's not like you can buy a tire, then use it on all your cars at the same time. While software has a different form, it's still the same principle.

Nope, doesn't just count for upgrades. Here is the Federal Court ruling regarding this issue.
